Security Deposit OR Damage Waiver REQUIRED:

Mountain Memories Cabin Rental, LLC now requires a $300 refundable security deposit with each reservation OR a $30 non-refundable damage waiver which will cover UP TO $200 in repair/replacement of damaged property at the rental unit. If renter elects to pay $300 refundable security deposit, the deposit (or remainder of deposit, if damages occur) will be refunded within 72 hours of departure cleaning.

If renter elects to pay the damage waiver and damages exceed $200, renter is responsible for the cost of damages.  Please call our office at (706)-698-6867 if you have any questions about the security deposit or damage waiver.

CHECK-IN & CHECK OUT:

You may check in directly at your cabin once all of the reservation requirements have been met.

We require final payment and a copy of the renter's Driver's License prior to/upon check-in.

Check-In is any time after 4:00 p.m. at the cabin. (PLEASE BRING YOUR DIRECTIONS WITH YOU AS GPS DOES NOT WORK WELL IN THIS REGION!)

Check-Out is at 11:00 a.m. Please adhere to the check-out time as our cleaning staff has limited time to prepare the cabin for the next guests. Please leave the key in the lockbox.

NUMBER OF GUESTS/HOUSE PARTIES:

Guest(s) agree that more than the number of people stated in the rental agreement will not occupy the cabin at any time for any reason.  If more than the number previously stated occupies the rental property, it will result in loss of total rent and/or additional charges per Guest.  Occupancy of premises shall not be the cause of any disturbance or offense to surrounding neighbors.  The use of fireworks and/or firearms is strictly prohibited!!

House parties, keg parties, excessive speeding or any disruptive behavior will result in guest(s) vacating the property immediately without a refund.

AGE REQUIREMENTS/FALSE PRETENSES:

You must be 25 years of age with a valid I.D. or Driver's License to rent a Cabin.  Parents, please do not call to rent a cabin for your children to use, as they will be required to provide ID upon check-in.  Thank you for your cooperation in this.

Violation of the age requirement constitutes a rental under False Pretenses and is in violation of this Agreement.  Guest(s) will be asked to vacate the premises immediately without refund.

RESERVATION REQUIREMENTS/CONFIRMATION:

To make a reservation, you must call our office at (706)-698-6867 OR YOU MAY BOOK ONLINE.  You will be required to fill out a general information sheet.  We require a deposit of 50% of the total reservation to be paid in advance to secure your Cabin.  This deposit must be paid with a credit card.  The Credit Card must be in the renter's name or their spouse's name.  Payment is expected in full within 10 days of arrival.  We accept money orders, cashier's checks, traveler's checks, credit cards and good old, US Dollars.  We do not accept checks within 30 days of your rental term.

You will receive confirmation of your Cabin Rental once you have made your deposit and filled out the necessary forms and faxed or e-mailed them back to our office.  Our fax number is (706)-410-2224.  Your may also scan and e-mail them to mtmemoriescabins@gmail.com. 

KEYS:

You will receive one set of keys upon check-in.  The properties are privately owned and Guests are fully responsible for keys that are lost, misplaced, stolen, or not returned for any reason.  The property must be re-keyed in the event that keys are lost or stolen.  The Guests will be responsible for the full cost of re-keying the property.

CANCELLATION POLICY:

Please call our office for any cancellations and all guest must submit a written request for cancellation of their reservation.

CANCELLATION FEES:

Cancellation request must be put in writing and sent to Mountain Memories Cabin Rentals. Anytime prior to 30 days before your check-in date you are subject to a $75.00 Administrative Fee. Cancellation of 30 days or less there will be no refund made, you may however change your dates for a $15 fee. If you do change your dates you must stay in the original cabin reserved unless the cabin is no longer in our rental program.

No Shows are subject to the entire rental fee in their rental agreement.

Cancellation policy also applies to last minute bookings. 

Sorry, No Exceptions to this policy, as we may have had to turn someone else away to book this Cabin for you.

RETURNED CHECKS:

There will be a $35.00 service fee for all returned checks.

LOCKOUT POLICY:

In the event Guests are locked out of a property, the Guest must call our Office number @ (706)-698-6867 or (706)-669-6223.  A representative will assist the Guest by providing a spare set of keys.  A $30.00 charge is payable for obtaining the keys after office hours.  After 11:00 p.m., the assistance of a locksmith will be required.  The Guests will be responsible for all costs thereof.

PET POLICY: PLEASE READ CAREFULLY!!!

Some of our cabins are pet-friendly, however, a non-refundable pet fee in the amount of $10.00 per night per pet is required.  Pet limits vary in each rental property.  The rental properties that do not allow pets include ALL PETS.... indoor or outdoor.  There is no exception to this policy as many people are allergic to pet dander and could suffer serious consequences.

IF YOU HAVE A PET AND IT IS NOT LISTED ON THE LEASE, THE UNAUTHORIZED OCCUPANCY OF PETS WHERE PROHIBITED WILL RESULT IN IMMEDIATE EVICTION AND LOSS OF ALL RENTAL MONEY!!!

Prior permission must be obtained and granted by Mountain Memories Cabin Rentals .  Specific rules will apply and must be abided by.  Pets are not allowed on furniture, bedding, or in the hot tub.  Failure to comply with this will result in additional cleaning fees not less than $100.00.

SMOKING:

Smoking is not permitted inside ANY of the Cabins!!!!  You may smoke outside, however, we ask that you keep the grounds free of litter and cigarette butts must be placed in the provided bucket/ashtray.  Thank you for your cooperation in this.  If there is additional cleaning required due to cigarette butts being thrown on the premises, there will be an additional cleaning fee applied of not less than $25.00.  Guest agrees to pay not less than $350.00 for odor abatement if they smoke in the cabin.

ALCOHOL & ILLEGAL DRUGS:

Consumption of alcoholic beverages is limited to people of legal age.  Illegal drug use is strictly prohibited and will result in termination of this agreement and immediate dismissal without refund.

PHONE CALLS:

All cabins are equipped with a telephone.  Guest(s) agree to use a calling card or call collect when making any long distance phone call from the cabin phone. 

LISTINGS & PRICING:

Information regarding cabin listings is believed to be accurate but cannot be guaranteed.  We have made every effort to ensure that all the information on our website is up-to-date and accurate.  The possibility of errors and omissions exists.  Our staff will be happy to confirm all information or answer any questions you may have prior to reserving a cabin.

DOUBLE BOOKINGS:

Double bookings are rare, but possible.  In the event that the Guest(s) reservation for the rental property overlaps or matches the reservation of another rental Guest(s), Mountain Memories Cabin Rentals reserves the right to relocate Guest(s) to another cabin.  The cabin could be within Mountain memories Cabins or with that of another company if needed.  Mountain Memories Cabin Rentals will make every effort to ensure that the replacement cabin is reasonably comparable to the original cabin reserved.  Mountain memories Cabin Rentals reserves the sole right to select a replacement cabin for reservations.  Mountain Memories Cabin Rentals agrees to pay any additional charges due in excess of the rental amount for the rental property, and refund any amounts paid by the Guest(s) in excess of the replacement cabin rental amount.  Guest(s) will have the option to accept the replacement cabin or reject the replacement cabin and receive a full refund.  Guest(s) agree that the choice between these alternatives will be the Guest(s) sole remedy for any and all damages, liability or inconvenience arising out of the double bookings.

CLEANING REQUIREMENTS:

Guest(s) are required to leave the property in the same general condition it was when they arrived.  Dishes should be clean and left in the dishwasher.  Mountain Memories Cabin Rentals will clean the cabin and clean all linens and towels upon your departure.

If additional cleaning is required, a service charge will be charged to the credit number on file.  Guest(s) are responsible for all damage, abuse, excessive cleanup requirement, or loss caused by any member of the Guest(s) party to the property or its contents during occupancy.  Mountain Memories Cabin Rentals will inspect each cabin after checkout to ensure it is left in good condition.  Mountain Memories Cabin Rentals will make the final determination of the necessity of any charges to the Guest(s) if necessary.

Hot tubs have been cleaned prior to your arrival.  There will be a $35.00 charge if you require an additional cleaning of the Hot Tub during your stay. If we come to find the cabin "trashed" there will an additional charge to your card depending on the severity of the cabin.

There is a Cleaning Fee for after guests check out that is added to the rental.  Fees vary per cabin.

REPAIRS/SERVICE CALLS:

Mountain Memories Cabin Rentals cannot guarantee against mechanical failure of heating, air conditioning, Hot Tubs, TVs, Satellite Receivers, VCRs, or other appliances or systems.  Please report any inoperative equipment to our office immediately.  Mountain Memories Cabin Rentals will make every reasonable effort to have repairs completed quickly and efficiently or may move you to another cabin if possible and subject to availability.  Should a repair technician make a call to a rental property unit and find that the equipment is in working order and the problem was due to the Guest(s) oversight or neglect, the charge for service will be at the Guest(s) expense.  No refund or rent reductions will be made due to failure of the appliances and/or equipment.  All maintenance requests must be reported to the office between 8 AM and 5 PM.  Guest(s) understands and agrees that Mountain Memories Cabin Rentals may enter the rental property at any reasonable time for the purpose of making any needed repairs.

REFUNDS:

Please keep in mind that the cabin has been reserved and held for each rental Guest and that others may have been turned away.  Construction of new accommodations and attractions does occur in resort areas.  Refunds or rate adjustments are not made for any inconvenience due to construction, road repair, wasps, lady bugs or similar instance.  Please do not ask for refunds.  No refunds for early departures (fewer days than reserved).  No refunds will be given for delayed arrival.  No refunds or rescheduling will be made due to inclement weather. 

Neither Owner nor Mountain Memories Cabin Rentals shall be liable for events beyond their control which may interfere with Guest(s) occupancy, including, but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, inclement weather and construction noise from nearby sites.  NO REBATE OR REFUND will be offered in these circumstances.

CABIN UNDER CONSTRUCTION:

If you have selected a rental property which is under construction and the cabin is not completed by time your arrival date, Mountain Memories Cabin Rentals reserves the sole right to relocate you to another cabin and the same rule applies as to Double Bookings.

RIGHT OF ENTRY:

Guest(s) agree that Mountain Memories Cabin Rentals reserves the right to enter the cabin at anytime to investigate disturbances, check occupancy, check for damages, to make repairs, alterations or improvements to thereto as Mountain Memories Cabin Rentals may deep appropriate.  

EVICTION:

A material breach of this Contract by Guest(s), which, in the sole determination of Mountain Memories Cabin Rentals, results in damage to the Cabin, personal injury to Guest(s) or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guest(s) tenancy.  Violation of any of the rules contained in this contract will result in immediate eviction and forfeiture of rent.

INDEMNIFICATION AND HOLD HARMLESS:

Guest(s) agrees to indemnify and hold harmless the Owner and Mountain Memories Cabin Rentals for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest(s) use and occupancy of the Cabin.  This is including, but not limited to any claim or liability for personal injury, injury due to Hot tubs, or damage or theft of property which is made, incurred or sustained by Guest(s).  The terms "Mountain Memories Cabin Rentals" and "Owner" is used in this Agreement shall include their heirs, successors in interest, assigns, employees, agents, and representatives where the context requires or permits.  The terms "Guest(s)", "You" and "Your" as used in this Agreement shall include Guest(s) heirs, successors, assigns, guests, invitees, representatives and other persons on the rental property during Guest(s) occupancy (without regard to whether such persons have authority under this Agreement to be at the Cabin), where the context requires or permits.

DISPUTES:

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia, and shall be treated as though it were executed in the County of Gilmer County Superior Court, State of Georgia.  Any action relating to this Agreement shall be instituted and prosecuted only in the Gilmer County Superior Court, Georgia.  Guest(s) specifically consents to such jurisdictions and to extraterritorial service of process. 

 MOUNTAIN MEMORIES CABIN RENTALS Reserves the right to refuse service to anyone.

All Cabins are leased without regard to race, color, religion, sex, national origin or handicap.  Due to liability issues, we are unable to provide prospective renters with keys to preview properties.

VIOLATING AGREEMENT:

If Guest(s) violates any of the conditions of this Agreement; Mountain Memories Cabin Rentals may terminate this Agreement and enter the Cabin.  Upon notice of termination of this Agreement, Guest(s) shall vacate the Cabin immediately and forfeit all rents.

CREDIT CARD GUARANTEE:

I __________________________________________(please type or print name) am providing my credit card number as a financial guarantee to Mountain Memories Cabin Rentals.  I agree to pay all rent, accept all terms of the lease agreement, and accept all liability for any damage, beyond normal wear and tear, during the term of my lease with Mountain Memories Cabin Rentals.  If I fail to do so, I understand that this cost will be charged to my credit card and all credit card sales are final!
